NAI Welcomes Bipartisan, Bicameral Effort to Enact a Uniform National Privacy Framework

Efforts should focus on preserving beneficial uses of data, and protecting consumers from harm

WASHINGTON, DC (April 9, 2024) – The Network Advertising Initiative (NAI) released the following statement from Vice President of Public Policy David LeDuc on the draft American Privacy Rights Act of 2024 (APRA), a discussion draft released by Sen. Maria Cantwell (D-WA) and Rep. Cathy McMorris Rodgers (R-WA):

“We welcome congressional action on a comprehensive national privacy framework that eliminates the confusing and inconsistent patchwork of state privacy laws. The release of a bipartisan, bicameral draft by the Senate Commerce and House Energy & Commerce committee chairs represents significant commitment and progress, but it also reflects many of the same problems that have stymied previous efforts to pass federal privacy legislation.

Rather than seeking to protect consumers from harmful uses of consumer data, the draft APRA broadly restricts data processing in a way that would curtail beneficial uses of data that consumers want and that business can provide responsibly. Further, the processing allowed under the APRA draft is subject to confusing and conflicting opt-out and opt-in requirements. 

Congress should enact a uniform national privacy framework that enables responsible data-driven advertising and marketing by drawing from the experience of more than a dozen U.S. state laws that allow tailored advertising as long as consumers are provided with clear and effective opt-out controls.”
