Privacy Counsel

The NAI is seeking an attorney to join its collaborative legal and policy team as Privacy Counsel. This cross-functional role supports the NAI’s substantive work across three areas: the member privacy review program; the development of ad-tech privacy guidance and best practices; and public policy and regulatory advocacy. This position reports to the General Counsel and works closely with the Director of the Privacy Review Program and the Vice President of Public Policy. Because the NAI is a self-regulatory association, Privacy Counsel does not provide legal advice to, or serve as legal counsel for, NAI member companies. Instead, the role helps shape and apply the privacy standards and best practices NAI members follow as part of the NAI’s self-regulatory program. It offers a unique mix of legal analysis, standards-setting, regulator-facing advocacy, and hands-on exposure to ad-tech privacy practices across 70+ NAI member companies.
Legal Internship
The NAI’s legal internship program is for qualified law students interested in privacy and digital advertising. This internship will provide law students with a unique opportunity to work on cutting-edge legal, policy, and technology issues impacting today’s online and mobile advertising world.
Public Policy Internship
The NAI’s public policy internship program is for qualified undergraduate or graduate students interested in public policy and the intersection of privacy laws and regulations in the digital advertising industry. This internship will provide students with a unique opportunity to work on cutting-edge policy issues impacting this industry.

Privacy Counsel

Duties and Responsibilities
1. Member Privacy Reviews
- Prepare for and participate in annual NAI member company privacy reviews — reviewing member questionnaire responses, privacy policies, and disclosures; helping lead review calls; and drafting detailed follow-up memos with tailored action items and best practices.
- Support new-member onboarding reviews.
- Support the NAI’s Precise Location Information Solution Provider Voluntary Enhanced Standards program.
- Help improve the privacy review process, report templates, and technical testing.
2. Industry Privacy Guidance and Best Practices
- Research and analyze U.S. state and federal privacy laws, regulations, regulatory guidance, and enforcement actions.
- Help develop NAI guidance, best practices, and legal research charts on timely privacy topics.
- Support and, over time, help lead an NAI working group or task force — setting agendas, preparing materials, presenting, and facilitating discussion.
3. Public Policy and Advocacy
- Track and analyze proposed and enacted privacy legislation and regulations relevant to digital advertising.
- Help draft comment letters and advocacy materials (e.g., CalPrivacy and state AG rulemakings, FTC matters, and federal proposals).
- Support engagement with regulators, policymakers, and industry partners, including preparing for and staffing meetings and events.
4. Other responsibilities
- Contribute to member communications and the NAI newsletter, and support cross-organization initiatives such as the NAI’s internship program.
- Support and participate in NAI events such as workshops, panels, webinars, and the annual NAI Summit; opportunities to represent the NAI as a speaker at both NAI and external events.
- Stay current on regulatory developments, enforcement actions, and evolving regulator expectations.
Qualifications
- Licensed to practice law in the U.S. and in good standing with your local bar.
- Experience with U.S. consumer privacy law (particularly U.S. state privacy laws) and the digital advertising industry, whether in-house, at a law firm, or in government. The role is well suited to an attorney with roughly 1–4 years of relevant experience, though we will also consider exceptional candidates outside that range.
- Working knowledge of digital advertising technology and business practices (for example, real-time bidding and programmatic, mobile and device identifiers, SDKs/tags/pixels, data clean rooms, de-identification and pseudonymization, and opt-out and consent signals such as GPC) and of the U.S. state privacy laws that apply to them.
- A strong sense of initiative and the ability to work both independently and collaboratively within a small team; experience with privacy reviews or assessments of data-processing practices, or with developing privacy policies and guidance, is a plus.
- Excellent legal research, writing, and organizational skills, and the ability to manage multiple projects across the organization. Ability to write well in both formal settings (such as guidance documents or member privacy review reports) and informal (such as blog posts).
- A genuine interest in consumer privacy and public policy.
- At least one CIPP certification (e.g., CIPP/US) preferred.
- Prior experience working with, or at, an NAI member company is a plus.
Compensation, Benefits, and Work Environment
- Hybrid role based in the Washington, DC area, with an expectation of roughly 1–2 days per week in the NAI’s DC office and flexibility to work remotely otherwise; fully remote considered for an exceptional candidate.
- Salary range: $125,000–$150,000 per year, plus an annual performance-based bonus. Final salary will depend on relevant experience, skills, location, and internal equity.

- Nationwide travel (up to 10–15%) and access to industry events.

Legal Internship

Internship Program Overview
The NAI’s legal internship program is for qualified law students interested in privacy and digital advertising. This internship will provide law students with a unique opportunity to work on cutting-edge legal, policy, and technology issues impacting today’s online and mobile advertising world. Interns will be provided an orientation explaining the various business models in the industry and the privacy issues with emerging technologies. Interns will have close interaction with NAI’s small, but sophisticated staff of lawyers and technologists. Legal interns will also interact with the world’s leading Internet and digital media companies. The internship schedule is flexible and can accommodate class and other schedules. There is a minimum time requirement of 16 hours per week during the semester. The NAI generally accepts up two interns per semester.
Legal Intern Responsibilities May Include:
- Monitor and analyze federal and state bills and statutes related to online privacy, data security, and technology issues
- Reviewing online privacy disclosures for required representations about data collection, use and retention; reviewing responses to compliance questionnaires, and participating in conference calls and interviews with members
- Assist compliance counsel with enforcement proceedings to determine the scope of alleged violations of the NAI Code by members
- Conduct legal research on specific topics such as tort liability, lobbying, defamation, intellectual property, and other issues
- Attend conferences, seminars, presentations, and hearings regarding online privacy, advertising and marketing, and related technology issues
- Monitor international developments in the areas of privacy, advertising, marketing, and technology and the implementation of new privacy legislation and regulations across the globe
Required Skills
- Excellent written ability, including the ability to draft documents, emails, and materials for different audiences
- Strong interpersonal skills and verbal communication skills
- Enthusiasm and interest in privacy, technology, information security, and/or Internet law and policy
- Desire to be creative and tackle novel, cutting-edge issues that may not be “traditional” legal issues – work assignments may involve the intersection of law, technology, policy, and business interests
- Course work in privacy law, technology law, intellectual property, communications law, and/or e-commerce desirable
- Basic familiarity with Web and Internet technology desirable (cookies, client/server model, web browsers, browser privacy settings, domain names, URLs, the basic elements of a website, etc.)
- Microsoft Office and Google Suite skills (Spreadsheets & Text Editing)

Internship Program Overview
The NAI’s public policy internship program is for qualified undergraduate or graduate students interested in public policy and the intersection of privacy laws and regulations in the digital advertising industry. This internship will provide students with a unique opportunity to work on cutting-edge policy issues impacting this industry. The NAI leads in the development of privacy self-regulatory guidance and best practices for responsible advertising technology companies, and we are the leading trade association promoting public policies that provide strong consumer data privacy, while also promoting the robust data driven advertising industry.Â
NAI Public Policy Interns will be provided an orientation explaining the various business models in the industry and the policy issues with emerging technologies. Interns will have close interaction with NAI’s policy and legal staff. The internship schedule is flexible and may be conducted virtually to accommodate coursework. The work requirement ranges from 16-25 hours per week during the semester. This is an unpaid internship, but in some cases the NAI may provide expenses to provide for attendance at related meetings and events.
Public Policy Intern Responsibilities May Include:
- Participate in the Government relations process within a trade association to gain valuable experience in industry government relations, public affairs, and strategic communications efforts,
- Conduct policy & industry research,
- Help draft newsletters, blog posts and educational material for lawmakers,
- Track federal and state bills and statutes related to digital advertising and privacy issues,
- Attend industry meetings, presentations and congressional hearings regarding online, privacy, advertising and marketing, and related technology issues (virtual or in-person depending on circumstances),
- Prepare summaries of hearings for the public policy team and member companies.
Required Skills
- Currently enrolled in Undergrad or Graduate Degree with relevant coursework, such as Political Science, International Affairs, or related discipline with a focus on public policy,
- Excellent written ability, including the ability to draft documents, emails, and materials for different audiences,
- Proactive and effective working both independently and part of a team,
- Strong interpersonal skills and verbal communication skills,
- Enthusiasm and interest in privacy, advertising industry and policy,
- Microsoft Office and Google Suite skills.
Skills & Education/Experience Preferred:
- Enthusiasm and interest in technology, public policy, and data privacy
- Experience with or knowledge of the digital advertising industry
- Interest in advertising technology
Work Environment
- Located in Washington, D.C., the NAI is a small but fast-paced, dynamic environment.
- This is a hybrid position, with flexibility to work in person at our office in Washington, DC and remotely. Under certain circumstances, this internship may be offered virtually.
